Tbis defendant was convicted of murder in tbe first degree and from sentence of death appealed to tbe Supreme Court, assigning errors.

We bave examined all of tbe exceptive assignments of error made by tbe defendant and find no error in tbe record.

Tbe contention of tbe defendant for judgment of nonsuit upon bis demurrer to tbe evidence (C. S., 4643) cannot be sustained, either generally or as to tbe charge of murder in tbe first degree, as there was sufficient evidence in tbe confession of tbe defendant to carry tbe case to tbe jury upon tbe charge of tbe capital offense.
