When this case was before the original panel the members were unanimous on the judgment which should be rendered but di*149vided respecting the doctrinal analysis supporting it. Two judges joined in an opinion supporting the judgment on one doctrinal approach. The third judge, the author of the majority opinion for the court in banc, filed a separate opinion.
