This is an action to recover on a check drawn by defendant, George Vassil, to the order of R.L. Jones Co. Hie check, in the sum of $9,490, was deposited in the Jones’ account with plaintiff, Community Bank. Plaintiff, as the holder of the check, brought this action after defendant stopped payment on the check. The case was tried to the court, sitting without a jury.
