TALBOT, Associate Justice.

—This is the second appeal in this case. The former appeal was from a judgment in favor of the present appellants, which judgment was by this court, reversed and remanded. Hubbard City v. Bounds, 95 S. W. Rep., 69. This suit is one instituted by the appellee, Hubbard City, to compel specific performance of a contract entered into between it and appellants for the construction and operation of a waterworks plant or system in said city, and to enjoin a breach of said contract on the part of appellants.
