The two issues raised by this appeal are: (1) whether the action below is a class action, even though the district court never certified a class as required by Fed. R.Civ.P. 23(c)(1), and gave no notice to class members; and (2) whether the stipulation executed by the parties and approved and entered in the court record by the district court in 1977 conferred authority on the district court to regulate the care given certain patients at a separate psychiatric facility located some distance from the institution named in the original action.
