The defendant Prudence Life Insurance Company issued to the plaintiff under date of May 18, 1959, a policy of in surance under the terms of which it insured the plaintiff “for loss of life, limb, sight or time resulting from injury, and for loss of time caused by sickness”. This action was brought by the plaintiff to recover benefits allegedly due under the policy for total disability due to sickness, and the defendant in its answer contested payment on the ground, among others, that the plaintiff had fraudulently misrepresented and concealed certain conditions of his health in…
