Plaintiff in error, Slemp Puckett, defendant in the court below, was indicted for the murder of Dave Wilson, and on *802his trial by a jury was found guilty of murder in the second degree and his punishment fixed at six years in the penitentiary. A motion was made to set aside the verdict on the ground that “the verdict was contrary to the law and the evidence and not supported by the evidence,” but this was overruled by the court and excepted to by the defendant.
The action of the court in refusing to set aside the verdict is assigned as error.
