*660In an action to recover damages for personal injuries, the defendant Stop & Shop appeals from an order of the Supreme Court, Kings County (Bonina, J.), dated November 26, 2002, which denied its motion for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is reversed, on the law, with costs, the motion is granted, the complaint is dismissed insofar as asserted against the appellant, and the action against the remaining defendant is severed.
