In December of 1986, Danilo Rodriguez was acquitted in federal court of charges that he conspired to possess and distribute marijuana. His court-appointed attorney, James K. Freeland, applied to the district court for an award of attorneys’ fees pursuant to the Criminal Justice Act (the “Act”), 18 U.S.C. § 3006A(d) (1985). Although Freeland had requested compensation in the amount of $3,850.00, the judge awarded fees only in the amount of $2,000.00. 1 Freeland now seeks appellate review of the district judge’s failure to certify a fee award in the amount requested.
