COLEMAN, Justice.

This is a suit brought by William Marsh Rice University, and the Trustees thereof, for the purpose of securing an interpretation of the organic instruments by which the institution was created that the Trustees, in the exercise of their discretion, are free to accept as students qualified applicants without regard to color and to charge tuition to those able to pay the same. In the alternative, the University requested the court to apply the equitable doctrines of Cy Pres and deviation if such action was found to be necessary in order that students…
