People v. Owens

Appeal from a judgment of the County Court of Chemung County (Hayden, J.), entered March 20, 2006, which denied defendant’s motion for resentencing pursuant to the Drug Law Reform Act of 2005.

In 2000, defendant pleaded guilty to one count of criminal sale of a controlled substance in the second degree—a class A-II felony—and was sentenced to eight years to life in prison. He subsequently applied for resentencing pursuant to the Drug Law Reform Act of 2005 (L 2005, ch 643 [eff Oct. 29, 2005]).
