Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which, inter alia, denied petitioner’s application for a transfer of ownership for a lottery license.

The issue here is whether respondent properly exercised his discretion in revoking the lottery license of petitioner’s husband and in denying petitioner’s application for transfer of the license to her.
