Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered January 3, 2008, upon a verdict convicting defendant of the crime of criminal sexual act in the second degree.
In June 2006, defendant was at the residence of the victim’s aunt and uncle in the City of Binghamton, Broome County. The victim, then 14 years old, often spent weekends there with her five cousins who ranged in age from 8 to 20 years.
