STATEMENT OF THE CASE

In July 1997, surgeons perforated Sharon Kuester's stomach while performing a silastic ring vertical gastroplasty, 1 and Sharon suffered injuries as a result. Shar on and her husband Daniel (collectively "Kuesters") filed a proposed medical malpractice complaint with the Indiana Department of Insurance and, subsequently, a complaint in Marion Superior Court alleging fraud against Dr. Margaret M.
