Pending is defendants’ joint motion for a new trial (“second new trial motion”) regarding juror William Griffith. 1

On May 23, 2007, twelve days after the jury returned its verdict finding the defendants guilty on all counts, and following closing arguments concerning the appropriate sentence, but prior to the sentencing hearing jury instructions by the court, the United States disclosed a contact that occurred that morning between a special agent of the Federal Bureau of Investigation (“FBI”) and Griffith.
