McCarran, J.:

The defendant was convicted of murder in the first degree for the killing of an Indian girl known as Bessie Andy. From the judgment, and from an order denying a motion for a new trial, defendant has appealed.

The killing took place on the main street of the town of Elko. The defendant, after throwing the girl into a mud puddle iii the street, and after stabbing another party, who appears to have been a companion of the girl on that afternoon, returned to the spot where the girl stood, and plunged his knife into her body some three of four times, causing almost instant…
