HERRMANN, Justice:
This proceeding requires us to rule upon the validity of the Commercial Traffic Ordinance of the City of New Castle and upon the question of whether the City is depriving the defendant of equal protection of the laws in the manner of the application and enforcement of the Ordinance.
The Ordinance recites the increase of commercial vehicle traffic in the City of New Castle and the hazard caused by such traffic to the safety of its residents and to residential property. The Ordinance prohibits the operation of trucks or other commercial vehicles, except passenger buses, “on the…
