In an action, inter alia, to impose a constructive trust, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Nassau County (Feinman, J.), dated March 23, 2004, as denied those branches of his motion which were for summary judgment dismissing the complaint and vacatur of the plaintiffs lis pendens.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and those branches of the defendant’s motion which were for summary judgment dismissing the complaint and vacatur of the plaintiffs lis pendens are granted.
