Appeal from an order of the County Court of Delaware County (Becker, J.) entered June 23, 2006, which, among other things, dismissed petitioner’s application, in a proceeding pursuant to REAFL article 7, to recover possession of certain real property.

In August 2005, the parties entered into a written contract for the sale of certain real property by petitioner to respondent.
