Appeal by the defendant, Ammi W. Wright, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 3d day of April, 1897,, upon the verdict of a jury, and also from an order bearing date the 30th day of March, 1897, and entered in said clerk’s office, denying the defendant’s motion for a new trial made upon the minutes.

1Opinion of the Court

Van Brunt, P. J. :

This action was brought to recover damages caused by the alleged neglect and refusal of the defendant to deliver certain stocks according to contract. The answer was a general denial. The whole negotiations between the parties were conducted by letter and telegram,, the defendant being at Alma, Michigan, and the plaintiff in the city of New York., On the 24th of February 1892, the plaintiff wrote to the defendant as follows: ' ’
