Reasons for Judgment

This matter is before the court on a motion for summary judgment filed by the trustee-plaintiff. This adversary proceeding is an action to avoid an allegedly preferential transfer, pursuant to section 547 of the Bankruptcy Code (11 U.S.C. §§ 101 et seq.)

A motion for summary judgment may be granted where there exists no material issue of fact, and the mover is entitled to judgment as a matter of law. Rule 56, Federal Rules of Civil Procedure. The purpose of a motion for summary judgment is to “test the intrinsic merits of the case and…
