OPINION

JACKSON, Commissioner.

This is an appeal from an order revoking probation.

Appellant was convicted of aggravated assault and granted probation on August 28, 1970. Subsequently, on May 3, 1971, the State filed a motion to revoke alleging that appellant had committed the offense of murder, thereby violating the terms of his probation agreement. From the record, it appears that the appellant was convicted of murder on December 8, 1971, and assessed a 45 year prison term.
