Judgment unanimously affirmed. Memorandum: Defendant was convicted, following a jury trial, of murder in the second degree (Penal Law § 125.25 [1]), attempted murder in the second degree (Penal Law §§ 110.00, 125.25 [1]), assault in the third degree (Penal Law § 120.00 [2]), and criminal possession of a weapon in the second degree (Penal Law § 265.03). The conviction *1011arises from an incident that occurred in Buffalo on August 10, 1991, when defendant fatally shot a 17-year-old male with an Uzi machine gun. He also attempted to kill the victim’s brother and another teenager with the same gun.…
