'Affirming.

The appellant, John C. Morton, alias Wilson, was tried in the Webster Circuit Court under an indictment charging him with the crime of grand larceny and by verdict of a jury declared guilty. Judgment was duly entered upon the verdict fixing his punishment at confinement in the penitentiary not less than one nor more than five years. He complains of the judgment and in seeking its reversal, assigns as error: 1. The refusal of the trial court to peremptorily direct his acquittal by the jury; 2.
