The defendant is charged with a violation of the War Emergency Act of the State of New York (L. 1942, ch. 445, as amd.).

As the trial of this casé was commenced by administering the ' oath to the People’s witness, an investigator of the Office of *617Price Administration, a United States Government agency, the defendant objected to the prosecution of the. case in the name of the People of the -State of New York by an attorney from the Office of Price Administration.
