Appeal from Manistee. (Judkins, J.) Bill to determine the rights of complainants in timber growing on certain lands. Complainants appeal. Decree reversed, and one entered in this Court for complainants. The facts are stated in the opinions, and in Benedict v. Torrent, 83 Mich. 181.

The bill in this case is fled to determine the rights of the complainants in and to the timber growing upon certain lands described in the bill. It appears that the lands were held by several tenants in common. The owners of twenty-three twenty-fourths of the land conveyed all their right, title, and interest in the timber to complainants. One Hart was the owner of the remaining one twenty-fourth which was not conveyed to complainants.
