The defendant in error brought bis action against plaintiff in error for injury to certain mules, which he alleged that he had sustained by negligence of the servants of plaintiff in error in running their cars on the *723Southwestern Railroad from the city of Macon to the city of Americus, Georgia.

The defendant in the court below, among other things, pleaded a special contract between the parties, of which the following is a copy:
