.Error to tbe Court of Civil Appeals for the Fourth District in an appeal from Bexar County Ida Landry sued the telegraph company and recovered "judgment. Defendant appealed, and on affirmance obtained writ of error.

Ida Landry sued the Western Union Telegraph Company to recover damages for the negligent failure to’ promptly transmit and deliver the following message, which was sent from Ganahl, Texas, dated on the first day of March, 1905, and was delivered at the office of the telegraph company at H o’clock á. m.: “Sam Roundtree, Schreiver,. La. Gus Landry very low. Send someone to ..me. Answer.” Signed Ida -Landry. ’ ' ' .
