This suit was instituted in the district court for Lincoln county to quiet plaintiff’s title to certain lands in that county, described in plaintiff’s petition. Defendant William Robb was holding as grantee of the defendant county, under a title obtained in a tax foreclosure proceeding which was void by reason of the fact that in such proceeding service was had by publication upon the then record owner as a nonresident, when in fact he was an actual resident of this state.
