HENRY, Associate Justice.

Defendants in error, except William M. Nunn, brought this suit as heirs of William B. Nunn against the said William M. Nunn and the plaintiffs in error. The object of the suit was to recover against William M. Nunn a judgment for money received by him as administrator of the estate of the said William B. Nunn and to foreclose a deed of trust upon land given by him to secure the payment of the money. Plaintiffs in error were made defendants, because they were in possession of and claimed the land. William B. Nunn died in April, 1861, and William M. Nunn was appointed…
