Matthews, P. J.,

This is a proceeding in partition. The petition was presented July 17, 1950, and a citation awarded to show cause why an inquest in partition of the real estate described therein should not be granted. An answer in the nature of a demurrer raising questions of law was filed and the matter is now before us on petition and answer. For a better understanding of the problems involved, we will repeat or copy here the material admitted facts, substantially as averred in the petition.
