The principal issue in this appeal is whether the trial court erred when it dismissed with prejudice the charge of bribe receiving in violation of General Statutes § 53a-1481 that was pending against the defendant, Edward D. Bergin, Jr. Bergin was the mayor of Waterbury from January, 1976, until December 31,1985. After his arrest on a warrant, the defendant requested an evidentiary hearing pursuant to Franks v.
