On December 19, 1894, L. A. Thomas executed two mortgages, one on the north-east quarter and one on the south-east quarter of section 3, township 12, north, range 5 east, in Montgomery County, Illinois, to James B. Russell, to secure the payment of two notes, each for the sum of $5,000, which notes were subsequently assigned to the Mutual Benefit Life Insurance Company. On the first day of July, 1897, the Illinois National Bank recovered a judgment against Thomas for $7,101.35, upon which judgment an execution issued on July 2, 1897. This…
