Appeal from an order of the Supreme Court, Jefferson County (Hugh A. Gilbert, J.), entered December 26, 2006. The order, among other things, granted the motion of defendant FortisUS Energy Corporation for summary judgment dismissing the second amended complaint against it.

It is hereby ordered that the order so appealed from is unanimously modified on the law by denying the motion in part *1194and reinstating the claims in the second cause of action for an equitable mortgage and a vendor’s lien against defendant FortisUS Energy Corporation and as modified the order is affirmed without costs.
