McCORMICK, Circuit Judge.
This action is the Texas statutory suit of trespass to try title to land. Alfred Ogden, defendant in error, was plaintiff in the court below, and plaintiff in- error, John A. Finch, was defendant. The plaintiff alleged that he was the owner of a tract of 640 acres of land known as “survey No. 43” made in the name of the Southern Pacific Railway Company; that the defendant, Finch, owned survey No. 44 in the same block of surveys, which, properly located on the ground, was immediately west of survey No. 43 ; but that Finch, wrongfully claiming that No. 44 lies further…
