MEMORANDUM AND ORDER

LUNGSTRUM, Chief Judge.

In this action, plaintiff Dederick Kelly claims that defendant Bank Midwest discriminated against him on the basis of his race in violation of 42 U.S.C. § 1981 in connection with his efforts to obtain a loan. 1 Both parties having waived their jury demands, a trial to the court was held from October 2, 2001 through October 4, 2001.
