HIGGINS, Justice.

This is a suit by appellee, Jones, against the appellant, the carrier of insurance under the Workmen’s Compensation Law for the Dixie Oil Company, to set aside a ruling of the Industrial Accident Board denying plaintiff’s claim for compensation.

The petition is in the usual form, but it is necessary to state some of the allegations thereof as follows:
