Appeal from a judgment of the Supreme Court, Oneida County (John W. Grow, J.), entered September 12, 2003. The *871judgment, after a nonjury trial, granted the petition and awarded petitioner the amount of $12,402.06.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law without costs, the motion is granted and the petition is dismissed.
