The opinion of the court was delivered by This case was decided and the judgment of the court below reversed and the cause remanded for new trial, at the June, 1894, term of this court (Irwin v. Irwin, 2 Okla. Rep. 180,) and the plaintiff in error has filed his petition for rehearing, which has been granted upon the question of the jurisdiction of the probate court in the cause.
