— In an action, inter alia, for a declaratory judgment, to declare invalid a tidal wetlands permit issued to defendant Ben Heller by the New York State Department of Environmental Conservation, defendants Ben Heller and Kelsey Marechal appeal, as limited by their brief, from so much of an order of the Supreme Court, Suffolk County (Mclnerney, J.), dated February 4,1982, as denied their motion to dismiss the complaint as against them as time barred pursuant to ECL 25-0404.
