Moneta Lynn Hill brought suit against her governmental employer’s self-insurance fund, Texas Council Risk Management Fund (the Fund), in an attempt to recover uninsured and underinsured benefits for injuries she sustained in the course and scope of her employment. Hill contends that UM/UIM coverage should be presumed to exist as a matter of law because such coverage was not rejected by the insured in writing as required by the Texas Insurance Code.
