The plaintiff, Horton, seeks recovery of damages from tbe defendants, McCord and Cosgrove, as executors under tbe will of O. B. Williams, deceased, claimed as tbe result of tbe alleged breach of an employment contract under which be became an employee of Williams during bis lifetime. The superior court sustained tbe defendants’ demurrer to Horton’s amended complaint. He elected not to plead further*. Judgment of dismissal was accordingly rendered against him, from which he has appealed to this court.
