I. We shall deal 'first with, the appeal of the plaintiff. The case was tried below to the court without a jury. We are required to find the facts as favorably “to the appellee as the evidence will permit.

For some time prior to the events involved herein, the plaintiff had a general agency located at Lancaster, Pennsylvania. This agency had charge of all eastern business. The name of the agency was originally Eickert-Mellinger & Company. This name was later changed to Rickert-Mellinger & Prince; and still later, changed to Kosmak-Mellinger Company.
