Appeal by defendant from an order of the district court for Hennepin county, Pond, J., denying a motion for a new trial.

This action was brought for the purpose of securing legal separation from the defendant under the provisions of G-. S. 1894, §§ 4814-4821. Plaintiff and defendant were married at Minneapolis on November 1, 1887, and lived together as husband and wife, with more or less interruptions, until shortly before commencement of the present action. Separation is sought by the wife upon the ground of cruel and inhuman treatment on the part of the husband.
