Appeal from Wyoming county court. Action by Coridon S. Thompson, as executor of the will of Daniel H. Pryor, deceased, against George Chick, for rent. From a judgment entered on a verdict directed by the court in favor of plaintiff, and from an order denying a motion for a new trial, defendant appeals. Reversed.

This action originated in justice’s court of Wyoming county, where the plaintiff recovered a judgment of $93.60 and costs, for rent claimed by the plaintiff of the defendant upon a verbal contract for the renting of premises consisting of a house and lot in *60Attica, Wyoming county, N. Y. The defendant appealed to the county court, and a new trial was had before a jury. The jury being unable to agree upon a verdict, the court directed a verdict for the plaintiff, for the amount of his claim; and the defendant appealed from the judgment entered upon that verdict, and brings the case before us.
