The defendant petitions this court by writ of habeas corpus for his immediate release. The defendant claims that he is *904currently being detained illegally because his statutory rights under CPL 180.80 were violated several weeks ago when the prosecutor failed to file a written certificate of indictment before the Criminal Court on the CPL 180.80 date and the defendant was not released.
