FOREMAN, District Judge.

Plaintiff is a federal prisoner currently incarcerated in the United States Penitentiary at Marion, Illinois. The defendant is the warden of that institution. 1

The plaintiff’s original complaint alleged that, while incarcerated at Leavenworth, Kansas, he was confined in a control unit for allegedly assaulting a federal employee. He then was convicted of assault and given a two year sentence. Six months later he was transferred to Marion, where he was confined in a control unit.
