This is an action for breaking and entering the plaintiff’s close and carrying away hay and apples. The question is whether, at the time of the alleged trespass, the plaintiff or his wife had the better title to the close.. The wife is not a party to the suit, but the defendants justify under her authority, and the real controversy is between husband and wife. They had been living apart for several years, and in 1891, there was a struggle between them for the possession of the land in question, and the crops growing upon it, attended with some violence.
