In a proceeding pursuant to article 78 of the Civil Practice Act for an inspection of the books, records and papers of Cocoline Products, Inc., the Special Term granted the relief prayed for in the petition without a hearing (Civ. Prac. Act, § 1295). This court affirmed the order of Special Term, but the Court of Appeals reversed and remitted the proceeding to Special Term for such hearing (Matter of Cohen v.
