The trial court denied special appearances filed by Appellants in the above cause. This Court affirmed the court’s order in part and reversed it in part by opinion dated November 17, 2004. Lattin v. Barrett, 154 S.W.3d 169, 2004 WL 2610452 (Tex.App.-Waco Nov. 17, 2004, no pet. h.). Appellant Kenneth Lattin filed a motion for rehearing in this Court on December 3. Lattin and Appellant Douglas Benson then filed a notice of removal of the claims against them to bankruptcy court on December 9.
